He is in constant pain, on medication and ended up in hospital for two weeks a month ago on massive doses of morphine. He is partially bedridden most of the time, some days completely. He is far from happy and bored out of his head. Having been through the doctors, physio, back specialist, back surgeon route he is now waiting on ACC to approve the paper work for spinal fusion. The paperwork takes a month - if you're lucky. Last week they said he needed a second opinion - and booked the appointment for him for 10th Dec! My daughter hit the roof - at this rate surgery wouldn't be till February. They relented and made a new appointment for tomorrow. We wait in hope. The kids have medical insurance so the operation will happen one way or the other. But they can't go ahead with it till ACC either accept or decline the claim. |

Or in my neighbour's experience to pay their teams vast sums to create wonderful plans (but then for them not to be implemented due to a shortage of actual workers). She was head injured last year falling off a push bike. |

ACC has nothing whatsoever to do with WINZ, so those who want to have a crack at that can start another thread if they wish. I'm still waiting to see whether the OP has actually got his facts right - direct from Winz - or is just having an immediate sound-off on the basis of 2nd hand information? (See my earlier post) i say that because on the only occasion I've dealt with WINZ they were helpful & informative. |

| 610765 | 2007-11-12 11:58:00 | The key phrase is "a relationship in the nature of marriage", all you have to do is prove that this is not so. Try searching the WINZ site for this phrase, it is my understanding that this is the way that the regulations and ultimately court cases in the event of a perceived fraud by WINZ are judged in court. The case worker is making their own interpretation and it will not hold up under scrutiny. Key elements are money changing hands for support from one person to the other to facilitate costs of running a shared household and that goods are shared. There are other factors but money changing hands is one of the key elements that must be met in any ruling. Clearly this is not so here in this example so I declare that the case is not made and WINZ should pay out. The other main factor is the 'ahem' intimate side of the relationship and the frequency thereof can be a sticking point but you need to say something along the lines of this being casual and intermittent, ie on the spur of the moment as you are both young, maintain that you are not in the habit of overnight stays, after all who can really say. You need to take in proof that both of you are paying separate rents for separate dwellings, you can do this with your respective receipts. Also helps to show Electricity payments that you have been making and a good one is ISP bills as this shows you are spending time on the internet at your place and this is verifiable. Thus indicating that you are not just paying rent on a dwelling whilst living at the other person's house. HTH, I have taken note of your what you posted as you can see Laura. haha. And no WINZ are not generally helpful and informative when they see a chance to avoid spending money unless you have your facts straight and put them on the line. Depends greatly on the case worker. |

Just having a relationship doensn't put them in that category. But I don't think he's stated they're not living together, so until he clears that up we're wasting our time speculating. |

We are 20 years old . Ive got bills of my own as well as my own rent . It's all in the reading Greg :stare: I hate New Zealand As bad as this seems no need for those sort of words . I am also going to guess that english is a second language here, if so then as others have pointed out if she used the word "Partner" then this would be why WINZ assumed there was a "living together relationship" as opposed to boyfriend / girlfriend relationship . Gather up some mail each showing your address differs to hers and head back down and get it sorted . |
