They don't have Windows CDs when they come new!!!!!

I have e-mailed them to this effect but I'm not expecting any budging. Problem is, it's REALLY at the wrong time of the month for me to not be able to sell computers. I bought up big time in anticipation of the 6 month break I now have.

At least their rule doesn't apply to laptops.

I don't see them winning. They can't impose a restriction or condition just like that.

If MS allows it, who is TM to change the rules?


Greven - I use Paragon now. Acronis had too many issues with SATA and various chipsets.

Their take is that MS doesn't allow it. Apparently, by selling these PCs I am a "System Builder" and are under the OEM license agreement which says sellers must provide the CD.

Total bull****, the computers are 3 year old PCs not new ones!

They won't even link me to the Trade Me rule that forbids me to sell them. They just basically say I'm not allowed to sell items that "may be illegal to sell".

Edit: And I'm sure they are under no obligation to allow you to sell a product on their site if they don't want to. Seems silly to say goodbye to all those success fees. I'm referring to the fees from ~80% + of computer sales on their site. It seems they're only targeting the dealers....

Edit 2: HP NZ does not have the recovery CDs because they no longer make them. Microsoft sells XP CDs for $50, not worth it. The set of recovery CDs that can be burned by the end user from the recovery partition use 18 CDs! Also not worth it (burning 18 CDs) even if I wanted to pay the $130+GST for VisualGroup to run a recovery on one PC.

I do it myself using WinPE and a .wim image. The reason I do it this way is because it's file level imaging which is non-destructive, so I can script moving Documents and Settings to C:\Backup and it won't touch it. I also don't need a separate partition.

If I end up providing CDs I won't bother with this though.

615050 2007-11-26 04:29:00 I never thought I'd say it, but Trade Me is not just a bunch of horrible idiots. I e-mailed them and explicitly asked that my e-mail be answered by a manager.

They have replied to my e-mail and pretty much said that they understand and agree with me, and that I may now sell computers without the CDs, provided that "the installed software is not a pirated copy".

Then, they went on to say that they have "clarified the policy with the team" to ensure that everybody is on the same page and I won't get another e-mail from a completely different person tomorrow telling me I can't sell them.

I can barely express how stunned I am - I was expecting a practically automated response quoting some barely relevant section of their terms and conditions and changing nothing.

At one point, Trademe came down hard on traders listing just an OEM Windows version with no hardware, just the cd.

I occasionally get people asking if the PCs come with the XP CD, which they never do except for some laptops. I sell computers with OEM COAs, and install XP OEM using that COA (or rather deploy an image, if I have many of them).

As the COA is the license there is no legal issue with that practice, but Trade Me was saying that computers with OEM software installed MUST have the CD as well.

I don't sell operatings systems on their own, but it's clearly not OK to sell OEM copies by themselves...

615053 2007-11-26 05:33:00 All the second hand systems I've bought came with burned XP CDs. I'm certainly not complaining. I've paid for the COA and I don't find it nice the fact I need to fork out so much money just for a CD. qazwsxokmijn (102)
