| 622734 | 2007-12-19 11:15:00 | The way my justice system would be if I was in charge would be to have road gangs like the U.S.A. does but I would get them to clear out all the Gorse, clean up N.Z,build roads,do community projects that need doing, wearing pink jumpsuits. What is wrong with gorse. It provides a great bed underneath for the native bush to reemerge. I remember coming back over the Rimutukas after being away for three years and being amazed at how the native was returning and then we had a dry summer and we had three dumb bastards throwing butts out the window and it had to go through the process again. |

| 622736 | 2007-12-19 19:23:00 | I look forward to having the fallacy of my argument exposed. :D There have been several cases here, and many cases in the US, where DNA evidence has revealed that juries got it wrong, even when at the time those juries were sure they got it right. A "degree" of murder/crime system is the only way to deal with that, but still mistakes are made. Sorry, but I don't buy that you can guarantee infallibility of juries/justice system. |

Bruce, the two tier system of dealing with murderers would have Bell & Burton gone. There is no doubt and no mitigating circumstances. Indeed both are quite proud of their actions. On the other hand Watson and Bain would not have met their demise because the Beyond Reasonable Doubt requirement must have been a borderline call in both cases. Im sure the Third line of protection whereby a policeman or prosecutor that deliberately fabricates or withholds evidence is faced with the same fate as his victim, would have seen both Watson & Bain walk. In both their cases there is some real dodgy evidence and in Bains case the Privy Council has made that point. However, I realise that the country is full of touchy, feely, bleeding heart liberals, so maybe we could have a system whereby they could put their hands in their own pockets and pay for the upkeep of these characters. The fact that in some way I am contributing to the welfare of Bell, Burton and probably a dozen others gets right up my nose! |
