| 624019 | 2007-12-25 02:43:00 | so you mean to say that if a pedestrian walks out in front of you on a road at such a time that there is not going to be a way for you to safely stop that it's your fault? Yes, definately. if i was doing 70kph or otherwise speeding it would legally be my fault despite them still crossing before i had come to a stop (or even started to slow down). If you happen to hit and kill the person then your up for manslaughter. In all the many kilometers I have driven a lot of unexpected things happen when you least expect it. My worst surprise was an Army Tank coming racing out of the bush and crossing the dirt road straight in front of me in the early hours of the morning in the outback Australia. At the time I was driving a Road Train with about 80 ton payload and bringing one of those to a halt is no easy task. I came close to having to clean down the seat. Speed was not an issue in this case, but had I been going a lot faster the Tank and I would have had a lot of damage. |

| 624020 | 2007-12-25 02:49:00 | I have also driven Trucks over most of New Zealand over a 20 year period doing Stock, General Freight, Woodchips and Logs. When I was doing Auckland - Wellington I used to drive by night as leaving either end at about 11PM or Midnight was significantly quicker than leaving at anytime between 5 and 9PM. It was not hard to stay to legal speeds and still do it an hour or so quicker by travelling at a better time. | Bantu (52) | ||

| 624022 | 2007-12-25 06:49:00 | Glad I hit a nerve. I can understand a driver giving the speed limit a bit of a nudge, and wanting to know when they are being monitored by the police. But its pretty damn weak and pathetic to claim the need to avoid prosecution based on being incapable of regulating the speed of their 2 ton wagon. Thats the sort of incompetence that needs to be removed from the road. |

If you happen to hit and kill the person then your up for manslaughter. well obviously there's going to be an investigation for anything causing injury, but has anyone been charged and found guilty of manslaughter when the pedestrian simply walks out infront of a car without looking and the driver wasn't speeding? It was not hard to stay to legal speeds and still do it an hour or so quicker by travelling at a better time. whoever doubted that traffic can make an hour - it looks like i was on the money:p whenever possible, i have always arranged my commutes to avoid heavy traffic, simply leaving extra early or extra late to avoid the 7am-9am and 4pm-6pm periods. one the bike it can only mean a difference between a 20 minute journey or a 30minute one, but the 20minute is so much safer - in a car it's both a time and stress thing. and of course a 6am start means either a 12 hour day with obvious cash benefits or an early finish... bit of a pain when i'm at uni with nothing to do though.... and both my previous and current employers have trouble keeping me and the full time staff working when i'm doing 5 times what i normally do outside of the holidays - i get told to take a lot of days off:annoyed: /personal woes |

Granted, No one was killed...but... A driver at work came around a blind corner, well under the posted speed limit,to find a van parked on the center line, He swung left to avoid it,ran off the road, and hit a power pole. He was charged, and lost his license, and that was after we sunk a fair chunk of cash into his defense. |

Common sense does not seem to enter into NZs justice system at all. |

| 624027 | 2007-12-27 05:08:00 | I got a ticket for not wearing my seatbelt today- in my delivery van. I have been told by police in the past I didn't have to wear it when doing deliveries in town, Which is what I was doing. My boss is going to write a letter as he’s adamant I shouldn’t have to pay it. But I have accepted that fact that I will have too. It’s only $150, not much really. I must say I’m a recidivous offender when it comes to not wearing a seat belt, in my car - I have had 2 previous tickets, and got let off once, and managed to evade being pulled over one other time. I always wear one on the open road (absolutely), but when doing multiple deliveries in town it seems pointless. Courier & Taxi drivers don’t have to wear one, although I’m not classed as a Courier as per say, when I’m doing deliveries in town, I’m much the same. |

| 624028 | 2007-12-27 05:42:00 | I once got a ticket for having no license . I was on my temp until the real one came in the post . Mine expired before it arrived . I tried to fight it but they said I should have just waited until it arrived . I even produced copies of phone calls/photocopies of forms etc to no avail . But that is tough luck . Radars are just another gadget for people to mod their driving with . So what is the real point of having one? To speed with a lesser chance of getting caught . maybe . |
