a week of poor connectivity over the christmas break due to the sudden server load, and a few ass-hats decide to sue for five million bucks, despite xbox live terms of service using terms such as "with all faults" and "as is"

man if only i could sue every time ihug gave me poor service, considering the cost of my broadband is much greater than XBL, and not having internet can actually cost me money along with hindering my gaming, i could go for $15 million at least!

and MS is giving all subscribers a free game... wish ihug would do the same for me every time they crapped out:annoyed:

and who's to say MS didn't plan for the holidays? of course they would have, they probably just underestimated or maybe encountered technical problems....

i hope the only reason this got to court is so it can be shot down and the idiots sueing landed with all the legal bills... but of course if MS loses the precedent set will basically ensure that all online services from now on will either be very expensive or not exist at all

628233 2008-01-12 07:47:00 Hardly the point what $5 million means to Microsoft. Sometimes stuff happens. So what if some gamers have the odd outage? Inconvenient - yes, annoying - of course. But lets sue MS? People need to get real. I have no great love or hate of Microsoft, but I am saddened by people who will take any oppourtunity to try to make money out of a situation that is probably nobody's fault.
Couldn't connect to every XBox Live game they wanted to.......Harden Up!!

628236 2008-01-12 11:06:00 i'll point out again that if MS loses this case, the next time any service goes down there will be precedent for more cases, meaning most the stuff we love and enjoy will either become very expensive or cease to exist at all because you can never guarantee 100% reliability of any system

it's not the money, it's the precedent it sets

628237 2008-01-12 21:26:00 And just to let you guys know, that article said a week of bad service, and guess what, it still isn't fixed. This has been going on for about 5+ weeks and it's stupid.

If only 5mil was gonna actually make an impact on Microsoft.
