Agreed if there is no doubt at all as to guilt. Like a confession for example.

What about various people who have sucessfully appealed or whom have been pardoned. We know that some witness can and do lie in court. Some will bring false complaints to the Police for their own reasons.

It's quite a long act and somewhat technical (IANAL) but it does give you an idea of the principles that judges are required to work under.

Don't criticise the judges if you think sentences are not long enough, judges are bound by the statutes that criminals are charged under and the Sentencing Act, and other guidelines etc. Criticise the politicians who make the laws.

BTW, if you adopt the "throw away the key" attitude like the "Sensible Sentencing Trust" seems to advocate, who's going to pay to keep all the baddies locked up for decades? And where are we going to build all the prisons? Would you want a prison in that vacant land two blocks from your house? Not trying to flame here, I just wonder about these things.

That is a good link. I have used it from time to time in the past and intend to use it in the future.

Personally I would not mind if we built a prison in my part of town. We could do with the increased population.

My biggest concerns regarding NZ's justice the system is the extremely light sentences and the luxurious prisons provided.

As of yet I have not adopted the "throw away the key" attitude, as I know my wallet will thin down feeding bastards meals and health care they don't deserve.
I will though when the prisons get rid of their LCDs, game consoles, extensive health care, spacious cells, basketball courts and all those luxuries.

And I also feel the death penalty should be introduced.

633578 2008-01-25 08:04:00 Civilised people dont use the death penalty. If you are pro death you are scum. I think the judges get memos from corrections asking them not to send too many people to them hence the light sentences.
What we need are more prisons and keep the bad ass prisoners locked for the whole sentence. Parole seems automatic and a waste of time for the judge to sentence someone to say 10 years if they are out in 6.
Or they factor in the parole to the original sentence like sentence the crook to 14yrs knowing he will be out in 10 yrs.

Think as you may, but I am staying where I am standing. Extreme criminals found undoubtedly guilty have no right to live, to walk amongst us. They violated their own right to live by senselessly killing others and made countless lives miserable, a living hell.

Not only the above, if we keep them alive, it's coming out from our wallets. I'd rather throw away my money to the bin rather than giving it to feed such criminals.

Haven't I told you that you are stupid to think like you do? More prisons at this stage means buying more luxuries like LCD TVs, game consoles, courts etc for scum that certainly don't deserve anything but suffering. Furthermore, do you even realise WE as the taxpayers pay for these scums' food, living space, first-world healthcare, and entertainment?


Parole seems automatic and a waste of time for the judge to sentence someone to say 10 years if they are out in 6.
Parole should only be available for some life prisoners - but only after a certain long time of confinement.

As much as I hate criminals, I believe some if not most of them still have the capability to turn their ways around after a loooong time of confinement. So if they seem to be refined after let's say 50 years, then let them free.

I'm quite happy for them to build a new prison 5Km away from every town/city in NZ.

There is no need for them to be within walking distance of honest folk.

Have you ever visited a prison? I did a few times when a mate was sent there for interfering with his daughter. The daughter had lied as was proven later.

Prisons should be used for keeping dangerous persons out of society in general. Courts sentence people as a deterrent to others in case they try the same trick.

According to your thinking people may as well go to prison rather than live on the dole or dpb. They may live in better circumstances.

Let us not forget the Parole board who let people out before the term is up.

Do not forget there is no JUSTICE. Only the laws which are enforced by the police.

And some people are less than honest as well.

If I saw a child going down the wrong track then they might deserve a quick kick where it hurts. This may stop the road to prison.

Please note that I do not condone bashing in general.

As a male person I would think twice about going into teaching or even having a grandaugter sitting on my knee.
