666726 2008-05-10 00:01:00 Well, "...a smack as part of 'Good Parental Correction'..." hasn't actually been criminalised in New Zealand, anyway.

The discretion on that point lies with the Police - you know, the fellas with school cert and six months training...

s59 (4) To avoid doubt, it is affirmed that the Police have the discretion not to prosecute complaints against a parent of a child or person in the place of a parent of a child in relation to an offence involving the use of force against a child, where the offence is considered to be so inconsequential that there is no public interest in proceeding with a prosecution.

So we now have the police as judge and jury. What a fiasco the whole thing is.

x2.

God knows why anyone would back Sue Bradford on her vendetta. She's an idiot with personal grievances and not deserving of her place in parliament.

The same people who smack the hell out their kids for fun are still getting away with it regardless of this amendment which effectively criminalises caring parents. It's not the police's job to act as judge. Any 'witness' can make an exaggerated accusation and the police will follow up based on that, causing hell for those involved.
There is a clear line between what constitutes child abuse and corrective, disciplinary action. That line has always been there. The small number of people who bash their kids for fun were breaking the law before this amendment. They are no more likely to be brought to justice now.
Instead we have a law disguised as a panacea for child abuse, which is actually just another step towards controlling people's lives.

The National Party voted for the Bill on the basis of that subsection (4) being added to the draft.

Really? They do it all the time though. They have a large amount of discretion in any criminal matter about whether charges are brought. It is very definitely part of their job and their brief.

Of course, they beat the c**p out of some people in the cells too, which isn't part of their job.

666732 2008-05-10 06:07:00 Children are just that, children. They have neither the experience nor the common sense to know what is acceptable behaviour and what is not.

Life has consequences. I would rather children learn this from the hand of a loving parent than from the fist of a stranger or the sentence of a court.

Smacking in moderation done without excess is not abuse. Abuse is abuse. If a child is smacked on the hand or bum for blatant misbehaviour, they will learn to become responsible, self regulated adults.

If no boundaries are set, we get the situation we see more and more often today. We reap what we sow, and youth violence and crime is arguably the highest today than any other point in history...after 10 years of PC hand wringing. Coincidence?
