The problem is still there.

Still think i should let them try to fix it? or is it refund time.


If you take it in again, you should tell them that if they send it back to acer, and it comes back with the same problem, that you will expect a full refund plus reasonable costs incurred, and it is their last chance as you have given them more than a fair chance to put things right. If they aren't willing to do that, then demand a full refund under the CGA.

It sounds like they are just trying to frustrate you and waste your time, and hoping you will go away.

You cannot demand a full refund under the CGA. You can ask for a refund and if they refuse you can take them to the disputes tribunal.

If I was in those circumstances I would be demanding a refund, and I would be pretty angry with Dick Smiths, as it sounds like they have breached the CGA by not repairing/replacing or refunding the computer within a timely manner. 3 strikes and they should be out. But you are right, you may need to take them to the disputes tribunal if they keep giving you the run around, which is what you are getting.
