At the moment anyone can join together with anyone else in our community and call themselves a club, team, group of mates...... Freedom of association meaning the right to mix with anyone you want, is a fundamental human right in a democracy. How do we outlaw gangs? |

| 687203 | 2008-07-10 02:32:00 | I thought Robert Muldoon passed a law, way back in the day, along the lines of two or more people meeting together constituted an "unlawful assembly". There must also be some additional qualifying words, otherwise getting together with your mates at a pub would fall into the same bucket... :D Is it just another case of enforcing the laws we already have, rather than muddying the waters by inventing new ones?? |

A gang is just a group of people, although nowadays the word kinda implies that it does illegal things . Hold on, they do illegal things . So why don't you arrest them for doing illegal things? Why do you think that these law-breaking gang members are going to obey a new law anyway? |

So why don't you arrest them for doing illegal things? Why do you think that these law-breaking gang members are going to obey a new law anyway? It's not about making the gangs obey a new law. Common sense tells you they don't obey any of them (or certainly have no respect for them) anyway. It's about giving law enforcement the power to get them off the streets, without infringing the rights of the likes of uniformed sports teams (for instance) who gather together in groups. And by the power to get them off the street, I mean something more than what they currently have, laws which if enforced without too much attention to civil rights (Do crims have civil rights? Should crims have civil rights? Guilty 'til proven innocent or innocent 'til proven guilty?), should be sufficient as they stand. robsonde has got it - it's all about definitions. But I like pctek's idea too!! :thumbs: |

Perhaps we should just shoot anyone we want to get off the streets? I understand that gangs are responsible for a lot of crime. But there are also sections of the public that are responsible for a lot of crime. Does that mean we go out and arrest people based on their ethnic background? Unsuprisingly, I'm going to say that they have to do something wrong before you can arrest them. Also known as innocent until proven guilty. |
