| 694001 | 2008-08-04 04:13:00 | If your employment contract says a certificate is required, then yes, you can be disciplined and warned for not producing one. However employment law is pretty fair, and I think if they sacked you straight off for a first infringement you could regard it as unjustified dismissal. If it's not in the contract, then they can't require one. If they think you're being unreasonably absent, then what they do depends on your contract. Repeated unexplained absences can be considered as part of general misconduct, but they can't just up and sack you for one or two instances, without issuing formal warnings and going through the process required by law. If your contract says you need to produce a certificate, you could try to get a clause inserted to say that the firm pays for the certificate, since they require it. Not all illnesses require a doctor's visit for medical purposes, simple colds being the obvious example. |
