700178 2008-08-25 08:07:00 Stark raving nuts, but of course, unsurprising.

Just one of those things that promote crimes rather than eliminate them.

700179 2008-08-25 08:11:00 Just a thought - could it be the Judge knows something we don't? Admittedly he hasn't posted his thoughts here yet, but surely that is just an oversight. R2x1 (4628)
700180 2008-08-25 08:22:00 According to the article the Judge does not want people to google their names.
First of all , anyone with a tree version of the 'paper" will be able to do that anyway.
Secondly, if there is a valid reason it has to be a overall suppresion
This is makes the Judge look very foolish

700181 2008-08-25 08:53:00 The trial will probably be a year away unless they plead guilty. How many potential jury members will have a stack of old papers lying around?

The judge does have some background in this area
"Judge Harvey teaches the Law and Information Technology course at the University of Auckland. The course looks at the way technology impacts on evidence, jurisdiction and freedom of information."

700182 2008-08-25 09:44:00 "Judge David Harvey said online media could not use the names, or publish images of the accused, to prevent the public searching for the information when the case comes to trial."

So if this ruling is allowed to stand then why would it not apply to all cases coming before the courts ?
Define online media, is that just established news sites like the Herald and TVNZ or does it include anything posted on the web ?
What if I posted the names to a overseas web site ?

This comes too close to censorship for my liking

"A point that needs making is that Judge Harvey is no mug when it comes to the internet. He has written a text book on cyber-law in New Zealand.

"On a technical level he probably knows more about the internet than any other judge in the country,"

700184 2008-08-25 10:02:00 A judge has today taken the unprecedented step of banning news websites from naming two men charged with murder while allowing newspapers, radio stations and TV networks to reveal who they are.

So non-news websites are allowed to publish the names?
