715386 2008-10-29 19:04:00 About 40 years ago the was a Magistrate named Stuart Hardy on the Bench in Hamilton.
His daughter had been killed by a drink driver.

Anyone who came up in front of Stuart Hardy SM for drink driving got at least 30 days inside - no exceptions.

That is how it should be.
Must we see there daughters killed,to make them exert justice and the law?

A flaw there somewhere!

Shows how much our justice system values that girls life, 18 grand at 125 dollars a week.

And how the country allows people to be killers.

I'm revolted and sickened, and this is just another case in a long list. Killing people with your car in NZ is almost condoned.

Shame on the driver, and shame on the judge, You failed. Burn them both.

Best they continue witting out tickets for loud pipes on motorcycles, that will fix it....
I dont agree with you much Metla, but yeah this is indeed shameful. The judge found in Bensleys favour because of no previous and hadnt been drinking.....??

For the judge to actually force an $18k payment is just insulting......How is it these judges appear so far removed from society and their expectations?

715388 2008-10-29 19:15:00 The judge may have taken into account that any normal 18 year old comitting this sort of stupid act may have learned a great deal, it must be a kick in the guts every morning to wake up and remember what you have done. What he did is inexcusable, but he is not going to be the only 18 year old to be that silly.
$125 a week from apprentice wages is quite a wake-up too.

I have a bit of a problem rationalising "deterent sentences" - someone is to be punished for an unknown act by an unknown person on a date yet to be discovered.
If the deterent works, no crime of this type will occur, so nothing has been deterred.
If it does not work, it was a futile exercise that failed.

Pretty hard to put numbers on that sort of deterrent.

I think thats the problem right their. 'deterrent', is that all you think a sentence should be?, would about punishment?

715389 2008-10-29 19:18:00 Eye for an eye is the only system that would work these days. Imagine the drop in crime if that was the case.

+1, if all else fails?........

Wouldn't a punishment BE a deterrent? Although in NZ's case it's more like a bloody invitation than a deterrent.

At this rate, the only thing that can stop this injustice is an array of crimes being done unto major MPs and judges. Sad state of affair, I know. But these high-paid morons need to put their feet inside the victims' shoes and feel some pain of injustice for once in their petty lives.

I agree with you,we could get some flyers done with pictures on them of course - to help the crimes find the MPs,judges homes,so they can get burgled and get their cars stolen as well and see how they like getting a fast respnse of hours later to attend a non pirioty little chance to solve the crime why are you wasting my time can't be bothered not important enough incident.

"Oh you said your a judge/MP we will be right there Sir/Madam,and we will solve the crime."(Stitch someone up as a last resort if we cant).

And if a boy/girl racer killed a member of my family they would pay for their crime against my family permanently like they have done to my family.

Eye for an eye tooth for a tooth is my justice system-if you dont like it, then dont do any crime against my family and I.

If you dont get justice what do you do, let the criminale laugh at you and your family who are in misery for what they have done....Hell No!!!!:angry

The justice system does not work everyone knows it,but some are just in denial.

MPs only pretend to care at election time - they might loose there high paying job and all those benefits/perks they get for themselfs.

Judges what do they care how are they going to loose their job?

Anyway that's my rant and it's just how I feel right now maybe I would feel differently on another day,but I sincerly doubt it.
