717831 2008-11-08 21:58:00 Perhaps you need to read a newspaper a bit more often, Its not rare, and if your only counting deaths then your only seeing the tip of the iceberg.

Perhaps we should have this conversation again when your 40 and see if life has taught you any lessons.

In places like the states, those cases would barely make local daily news. Same in UK, France and most of Europe.

We see individual violent crime cases spread out for weeks on the news.

But it just occurred to me that I live in Wellington, where it's a touch rarer, and you live in Wanganui, where it seems that it's not.

My part of town is fairly low on these things, and for the most part I feel incredibly safe. Although you're absolutely right, we should always strive for better.

A District Court judge cannot be removed from their position except in cases of incapacity (illness, in other words) or misbehaviour - this has not happened in the history of NZ.

A High Court, Court of Appeal or Supreme Court judge cannot be removed from their position except by an address of the House - that is, Parliament, sitting as the whole House. Once again, this has never happened.

Also, the salary of a judge cannot be reduced in their lifetime.

These mechanisms are in place to prevent politicians from being able to interfere with the judiciary. It is known as the doctrine of Separation of Powers.

If politicians were able to influence the juduciary this would effectively place them above the law.

Not that much on balance. Nothing that makes me feel less safe anyway.

Most of the time it's not just some nutter walking through the door and doing this stuff anyway, it seems to happen to people involved in shadier stuff anyway.

I've almost been mugged once or twice, and been threatened a few times, but always when I've been in places I shouldn't have been. Haven't had anything in the last few years.

No, Deane, they "cannot be removed .. except in cases of.." isn't how it actually works in reality.

That rule was made for very good political/democratic reasons, of course. Nobody should object to it.
But to say "This has not happened in the history of New Zealand" gives a false picture of judicial purity.

I recall just off the top of my head 3 district court judges who've gone in recent years - not because politicians sacked them, but because they resigned after being publicly compromised for one reason or another.
Actually, I see this as a strength of our system - as opposed to "bought & paid for" judges in some countries.
It shows that even judges must take account of public opinion in communities they have to live within later.

But let's not kid ourselves that our justice system
is perfect just because parliament can't dump judges.
Peer pressure can do that just as well in a small democracy.

The judges resigned rather than be removed. In the case of the two District Court judges who submitted false expenses claims one resigned after pleading guilty to the charge and one (Beatty J) successfully defended the charge. His Honour Judge Beatty refused to resign and is now hearing ACC appeals (a section of the District Court and the first level of appeal after ACC review) right here is Chch - and he has made what in my opinion are some very poor decisions in that court. He was demoted, in effect - and this was not a satisfactory outcome in respect of the level of probity we normally find on our bench - and nobody pretended it was. I was one of the many people who wrote to the Minister of Justice at the time.


But let's not kid ourselves that our justice system is perfect just because parliament can't dump judges.

I certainly wasn't kidding myself that it is perfect - I was responding to some idiot who thought politicians should be able to sack judges.
