732765 2008-12-27 21:15:00 first thing is to ask the neighbours to the farmer if he regularly has stock loose.
we have had major problems with one farmer who never does any work on the farm. after many years of abusing livestock SPCA dealt to him.

but other than that its just part of life. thats why you have insurance.
I've seen cattle jump clean over a gate, sheep that push through fences, cattle demolish fences !
I've had some very close calls, cattle that scraped down the side of the car, turkeys bounce off the windscreen, run over the odd dog.
black cows sleeping on the road at night is the worse.

732766 2008-12-27 21:17:00 Accidents happen, There arent many country folk who havent hit animals at one time or another. Just get over it.
And the driver/rider is sometimes to blame for going too fast.

Accidents don't just happen, Accidents have a cause, Whomever is at fault for the incident needs to change their behaviour to avoid it happening again, as next time it may well kill or cripple someone.

Rather then "just get over it" so we can all have a chance of getting killed the farmer should be held accountable and forced to upgrade his fences and work practises.

I agree dumb animals have a uncanny knack of finding a hole in a fence.
Anyone can hit animal but if you are driving at slow speed accident damage will be minimal. City slickers seem to think its ok to do 100kph on a winding gravel road then when they hit a moo cow its the poor cockies fault.

It was a sealed road and I was under the speed limit - if it was a moo cow I doubt I would be writing this now

732770 2008-12-27 21:56:00 If it was the farmer's dog that had got out and bit someone you can bet your **** that the farmer would get fined!
So why not the same for stock?

732771 2008-12-27 22:02:00 Yea, like any business you are liable.
The farmer have to fess up. If he was a good man he would've put his hand up first, but thats unheard of these days.

732772 2008-12-27 22:23:00 What to do about accidents with animals
If you injure a domestic or farm animal on the road, you must tell the animal's owner as soon as possible (no more than 48 hours after the accident). If you are unable to contact or identify the owner, you must report the accident to the nearest police station or to an enforcement officer as soon as possible (no more than 60 hours after the accident).

Why not?
Because not all people are city slickers although all city slickers are supported by the primary producers.

fences cannot keep livestock in ALL the time.

it comes down to can you PROVE that it was his stock, came from his farm, and he was negilant ? bloody hard to do that at the best of times.
if the farmer has a history of stock getting out then you have a good chance.
