743074 2009-01-29 21:35:00 My friend recently got his internet cut out and received a call saying that he had been disconnected because he it was suspected that he had been downloading copyrighted material. I didn't know that ISP's had even started doing so. NG mentioned that it wouldn't start till the 28th of February, and he's with Telstra one of the ISP's that spoke out against the new law.

I have know idea whether he was downloading illegal software, movies, etc. I personally use uTorrent, a lot, but all my downloads are open source or not copyrighted. Just thought some people might want to know is all...

743075 2009-01-29 21:39:00 Doesn't the law say that you will get two warnings first? CYaBro (73)
743076 2009-01-29 21:43:00 Nope. He got no warning at all. He also received a call saying that his computer might be searched...? AMD3ALL3THE3WAY3 (116)
743077 2009-01-29 22:19:00 Ive got a copyright notification once... they cut us off so that we would ring Xnet and talk about it, coz they *apparently* tried to ring me but couldnt get through (Yeah right, I have my Cellphone on me 24/7, never got any call), so after a week they cut our 'net in order to get us to ring them.

I was not impressed!

Here's the section detailing it:
www.legislation.govt.nz

“92A Internet service provider must have policy for terminating accounts of repeat infringers

“(1) An Internet service provider must adopt and reasonably implement a policy that provides for termination, in appropriate circumstances, of the account with that Internet service provider of a repeat infringer.

“(2) In subsection (1), repeat infringer means a person who repeatedly infringes the copyright in a work by using 1 or more of the Internet services of the Internet service provider to do a restricted act without the consent of the copyright owner.

So to be a terminated you need to have already infringed copyright material. But who wants to lose a customer? I wouldn't be surprised if some ISP's put the cut off point at half a dozen if not more.

743080 2009-01-29 23:52:00 I certainly hope Nat Party will re-look at this law, as as it stands, accusation seems to be enough to disconnect the customer..

I am absolutely flabbergasted that Labour passed this bill. Thank Christ they are gone......

You probably aren't a great supporter of the only Parties to vote against it.

"A party vote was called for on the question, That the Copyright (New Technologies) Amendment Bill be now read a third time.

* New Zealand Labour 49
* New Zealand National 48
* New Zealand First 7
* ACT New Zealand 2
* United Future 2
* Progressive 1
* Independent 2 (Copeland, Field)

* Green Party 6
* Māori Party 4

Bill read a third time."

Govt rejects calls to alter internet law www.stuff.co.nz

"Communications and Information Technology Minister Steven Joyce acknowledged concerns about the law's implementation, but stopped short of saying it would be reviewed.

"We will keep a close eye on how the new law works in practice. We are prepared to look at further changes if they prove necessary.""

743082 2009-01-30 00:46:00 Im not sure that its the isp's doing it

Cos my mate had xnet ring him and have a big moan about illegal downloading (which he is guilty of, but arent we all from time to time?). Anyway they were ringin because paramount pictures had contacted them about "their growing concerns" etc etc

I think xnet only gave him a ring to get paramount off their back, cos obviously they want to keep customers. They said behave for a month or two so they can monitor his usage and get the all clear etc

Might just be this case but it makes sense in my mind, cos isps couldnt care less what we use there service for could they? as long as we're paying customers
