Of course it's legal.

When the user installs or activates the product, the agreement for the company to access their credit card in perpetuity is in the fine print.

Which no-one reads.

Whether it is ethical is the more pertinent point....

744082 2009-02-01 20:44:00 Had that with some paid antispyware last year that I have been using for years, it was due for renewal - I wrote Via their web site saying I didn't want it renewed again - they didn't respond - so I went to the bank and got them to reject any transactions from the company concerned.

Funny how about four days after it was due to be renewed I got an email from them saying the transaction had been rejected - and please supply new credit card details - I wrote back advising why it had been rejected - never did hear back from them.

And as for legalities:
There is now no opt-out process at the time of renewal.

Customers are advised in the email that gives instructions on how to cancel automatic payments that by doing so they are opting out of the ''automatic renewal feature of Norton Ongoing Protection'', but the confirmation form incorrectly advises customers that they would actually be opting out of Norton Ongoing Protection if they proceed.

That creates the potential for people to be misled into thinking that if they follow the instructions in the email, they may lose the entitlement to automatic updates of their Symantec product during the period of their paid subscription.

Might be legal some places but I doubt that is here.

Most people I know would much rather be given the flashing alerts to say "Hey its about to expire, please renew" than to have it automatically rebill.

That said, when I was doing IT for home users etc, I would semi-regularly email them asking if their AntiVirus was doing OK, if they'd experienced any slowdowns, any popups were occuring. That alone would usually catch the few people who'd let their free AVG lapse and not change to the newest Free version 8 (Or same for Avasts 1yr free license that needs renewing).

That seriously sucks coz its included with most PCs thou :(

Only reason I found out they changed it was one day a customer of mine rang and asked what the deduction from her Credit card was for from them - so they never even advised it had changed to an auto renewal .

When it was renewed manually, the expiry date simply changed .

If that happened to me I would contact Card Services and ask them to stop the payments and retrieve any unauthorised payments that have been made .

Some years back I had a pommy firm continually sending me unsolicited material and charging it to my account . (I had only asked for one product, not the dozens that they continued to send me . ) Card Services not only stopped the payments but made certain I was refunded all that I asked for .

It was a bit of a job but the outcome was good . :)
