You possibly mean precendent.

The law is not in force yet.

It would imply that you are guilty until proven innocent.

There are only two verdicts presented in NZ courts.

Guilty or Not Guilty.

Unlike the courts in Scotland which are different where they come up with "not proven".

Not proven means that there is not enough evidence to convict.

Nowhere do I see a court where the verdict is pronounced is Innocent.

749862 2009-02-21 13:45:00 Limewire on its own is not the problem - the actual program is not illegal, and there are many legal downloads that are being brought through Limewire.

Its what people are using Limewire for - meaning downloading illegal content. Heres an example - Say some one writes a book and distubitues it Via P2P - more or less saying - here take it for free - not a problem and nothing illegal.

As for every one laughing at NZ--- There is already a court case as described here in Aust last November (whirlpool.net.au) - of an ISP being taken to court for not doing enough to stop illegal downloads.

Interesting...so what was the Australian court result?

749863 2009-02-21 18:35:00 I think you will find Sweep, that the concept is that you are innocent until proven guilty.

This law reverses that concept.

When you are arrested you are "alleged" to have committed the crime. It is up to a court to judge your guilt or otherwise.

Guilt upon accusation sounds barbaric and reminds me of Nazi Germany or Stalinist Russia.

Just been having a "Hunt" on google- and apparently the court case was meant to have started on 5th February - being like most courts it will drag on for months no doubt - but I wonder if "no news is good news" actually means things are not going as planned by the film industry ??

If you do a google search for the case, many articles speculate what will happen.

Confirming what limepile wrote in the first line.

An article in the herald, 22nd Jan - part says:
accused copyright offenders will initially be warned with suspected repeat offenders ultimately being disconnected by their ISP.

The ISP's are caught between a rock and a hard place - IF they dont do anything,they may end up like iiNet - if they disconnect people then the ISP is the bad guy.
While no one likes being told you "cant do that" - many ISP's have in their terms and conditions of usage, something relating to illegal activities - so technically if some one is downloading illegal content, they are breaking their own agreement with the ISP.

Saying " they didn't read the contract " before clicking or signing "I Agree" doesn't cut it.:groan: ( I've proved that with a small claims court case I was involved in a few years back)

If this doesn't prove that labour should never be allowed to govern again nothing will.
Other people must agree, opinion polls put fil gof at the lowest preferred leader of an opposition party since polls were commissioned.
