That,s rubbish, If someone goes on the attack and you don't do what needs to be done then you lose, lose badly.

You have to fight for what's yours, even if all you have is pride.

753771 2009-03-05 21:12:00 The reason I settled for such a low figure was that I'd have to wait probably another 6 months before an actual hearing, and then if she appealed maybe 1 or even 2 years after that before I got any cash. And even then the outcome was never guaranteed; in other words I could have received as little as 10K.

I thought the law was clear on divorce: a 50 / 50 split of all assets.

What circumstances lead to something other than 50/50?

If you had just split 50/50 amicably then neither of you would have lost out.


Sensible advice but sadly it only takes one to make a fight. Amicable settlements require two reasonable people. If one person becomes bitter and vengeful then you've got a battle on your hands like it or not.

To begin with not all assets - gifts and inherited wealth are separate property and outside. Property held by a Trust is outside.

So what do you do where the home is owned by a Trust set up by your parents-in-law? You both live there very happily for the first 15 years. You pay the mortgage (instead of rent), build new decks, landscaping, put in a pool, double garage etc etc.

Then your partner meets someone else........ Sadly it happens. You don't own the house. Even your partner doesn't own it. But you are out on the street with nothing after 15 years of marriage, three children, child support to pay.......

I could tell you of some. In fact one lady pays Child Support, plus has the kids half the time, and the husband pays her nothing. Unfair but legal.
