Rather, we in NZ, use common law and Acts etc. This being based on the Westminster system. Sometimes the Police have no alternative as they are sworn to uphold the law as it stands so therefore the alleged offence sometimes goes before a Court that has jurisdiction on the matter. The fact that the Shopkeeper case was dismissed creates a precedent and therefore the Police may be unlikely to prosecute if they feel they will not win. The Police (or Crown) in that matter have the right of appeal to a higher Court in the event they wish to pursue it further. What do you mean WHAT God, their is only one! (IMO), and according to American, defending yourself is a God given right... |

| 760985 | 2009-04-02 01:00:00 | Continental Drift has sped up.... Personally I can't see NZ getting very much closer to America geographically in what I have left of my life. To keep this on track I do have a .177 air pistol in my house along with carving knifes etc. I would hesitate before using but if faced with the situation as I find it then the intruder may find that he/she bit off more than they can chew. In my car I have a jack handle which could be used as a weapon possibly. I don't roam the streets with a baseball or cricket bat in my hand though with intent to cause harm to others for no apparent reason. |

Take these circumstances for example. www.icbc.com Some people may suggest when I find an intruder in my house I should sit down with this person or persons and go into discussion about why they are there. If I find the explanation not to my liking then of course I advise the person(s) that I am going to phone the Police who may turn up eventually or not. |
