| 772152 | 2009-05-08 03:25:00 | Bought a chainsaw a while back off Trademe . Trader sold a chainsaw to us under username "eminel" . . trademe . co . nz/Browse/Listing . aspx?id=201474894" target="_blank">www . trademe . co . nz Chainsaw not as described . Chainsaw did not start at all . When Trader was contacted he became abusive . We requested a refund and he sent a series of emails threatening us and accusing us of breaking it . We took it to Disputes where it is ongoing . He delayed the first hearing by 3 weeks . Then after originally accusing us of breaking it by using a fuel mix of 50:1, he changed his story and said the one we were going on about is not the one he sent us . He also proceeded to launch into a long story about how he was a logger but had an accident (described in detail) but now he was on ACC and cannot work he is selling off his saws . He spok for an hour and a half, citing a lot of stuff he was told was irrelevant . He also said that the day we phoned about the saw, he had come in from a hard 8 hrs in the forest working . He also accused the Disputes person of being prejudiced in favour of us due to the fact that we were all in Gore and he wasn't . (It was done via phone conference) . The Disputes person pointed out that unlike a criminal court we do not have to prove our case 98%, just satisfy her to around 50% . She adjorned till that afternoon but he wasked for a new date as it wasn't suitable fo him . So that was scheduled for today . Got a call this morning from Disputes, we were due to have the 2nd hearing today at 1:30pm . The guys wife had rung to say he couldn't come as he had to go to hospital . I pointed out this is now 3 months . He delayed the first hearing for 3 weeks . They wanted the Husqvarna agent who did the report on it to be available and I had contacted him to arrange that . I said I would not contact him again and they would need to . They checked and said if he delayed again they would need proof he couldn't make it . She also noticed he has now filed an appeal and will tell the mediator this as he can't as the decision has not yet been made . Also he can only appeal the fact the mediator was not fair with him presenting his case, not against whatever decision she has made . And I found out he has done it before . He sold us the saw under his sons Trademe name - eminel . He has his own - stevie25 . This is why he did that: Feedbacks: stag101 (25 ) 26 Aug 2008 stevie25 was the seller (#170660990) This guy is full of empty promises,dont trust him . toots1971 (93 ) 18 Apr 2007 stevie25 was the seller (#95558700) we bought this item at buynow for $525 . 00 and wanted to come and look and pick it up,but would not let us,which we thought was suspect,he got abusive&threatening,so we put the money in his account,then he emailed us back and said we could not have the item&said he will send a bank cheque which he did days later but only $497 . 00 which he stole,he says hes a forestry worker and that means his items are no good,wouldnt trade again and anyone who wants to deal with this guy think again . paripapa (30 ) 12 Apr 2007 stevie25 was the seller (#91697046) Didnt get all that we bought, and did not receive either of the 2 extra "Brand New" oregan chains promised, or the extra 20" bar . seller gave 2 different excuses, firstly saying accidently didnt post then informed us after buying that the extras offered at buy now werent meant to be on there . (We did receive 1 extra used chain in the end . Still never got the "New" 14" chain, or spare 20" bar . Happy with saws, but overall a bit dissapointed . |

| 772154 | 2009-05-08 11:15:00 | A few comments: 1) He would seem to be a nut 2) His accident may be a factor if there was a head injury. 3) A lot of forestry workers spend much of their day on cannabis, and years of this may have also screwed up his brain. 4) Buggering up the fuel mix will not damage a motor that is NOT running. You have my sympathies in being stuck in a bad trade with him. Despite the Disputes hearings, I doubt you will ever see a satisfactory resolution. His 'crime' isn't so bad that he will be faced with prison, and a guy such as this will never pay any form of reparation completly. Consider yourself lucky that your contact with him has only been remote - via phone / internet / mail. I'd be keen to ensure it stayed that way. My own experience through work - 2009 has been remarkable for the higher proportion of nutters and neurotics causing grief. |

Whenever I browse through auctions I check the feedback of the bidders and people asking questions if they have a number of bad feedback I just blacklist them. Not sure about other people but I am at 150 trades and still 100% good feedback and I guess the only way to maintain 100% good feedback is to make sure people who could undermine my 100% good feedback are vetted and eliminated. Put the 2 from PCTEKS chainsaw trade on. I do confess TM has contacted me about people complaining they couldnt bid on my auctions because they were blacklisted |

Just because people aren't knowledgable about the product (yet) doesn't mean they're not capable of completing the purchase properly. And often by the time people ask enough stupid questions, they learn and start to ask intelligent questions :p - assuming you give them a good answer. |
