| 771576 | 2009-05-06 21:48:00 | Apparently while the lawyers were abusing eachother in court, they were also making a deal out back how to work it out with the new XT network....and theres a media thingy at midday today. What really gets to me is why did they still waste an entire day in court when they are also somewhere else making a deal? Hope the Judge finds out about this and slaps them with the bill for everything, judge, power, room rental etc... Am quite interested what the deal is.... **** Yesterday, lawyers for the two phone giants faced off in court over claims by Vodafone that Telecom's new XT Network was causing serious interference to customers on its own network. At the same time, the two companies were understood to be negotiating behind closed doors. An announcement is expected at midday today. |

I really want the Judge to tell us his decision, would have been interesting to see if he actually ruled in vodafones favour or telecoms... telecom still gets its fast network, just 2 weeks later, dont see how this is going to change it for vodafone.... |

| 771580 | 2009-05-06 22:48:00 | Yeah, Vodafone won. Look at the scenario... Vodafine already HAS 70% of the market. Telecom is coming in with a faster product, and is simultaneously accused / suspected of buggering up the dominant player - a Telecom tactic that does not seem out of character at all. Imagine the much greater uptake of users they'd get if Vodafones service was degraded. THey wouldn't need to compete on service or price - the customers would just pour in because their existing service was poked. Now Telecom has to do more to make the new service appeal. Speed, price, coverage... Personally, because of price, I totally avoid all but SMS use whenever I can - and who needs greater speed for that? For users like myself, this new network offers no incentive to upgrade... unless my existing srvice is degraded. Sounds like they are simply hastening their installation of filters, which had conveniently been delayed till after the planned launch, and the use of lawyers is the usual necessity to get Telecom to play fair. Until the threat of being penalized is real, Telecom will continue to push the boundaries of fair play... as evidenced by the Commerce Commission being perpetually investigating them. |

I would say the judge would have first told them off for wasting court time, and then would have probably given a similar decision, as it is a compromise (lose lose for both parties) As long as telecom launches before the next iphone is launched, they will be happy. I think it is actually a win for telecom, becuase it makes VF look very agressive, in a market where they are going to lose customers to the new xt network. There is nothing however stopping them investing more of the huge profits they ship offshore, back into their NZ network , to get it back up to the speed and quality of XT. |

| 771584 | 2009-05-07 03:23:00 | From an observer: My comment is that while Telecom will have the faster network with possibly greater capacity /for now - /Vodafone still has the better product over all + market share + plus a more advanced iPhone coming in June which Telecom doesn't have. Also the current Sony Ericsson being promoted still doesn't come close to the iPhone ( Telecom doesn't even have an apps store for the phone and neither does Sony) Both will need to continue upgrading their networks and increasing capacity to meet the growing demand from users. |
