| 779512 | 2009-06-05 23:22:00 | The problem is the judges dont use the maximum sentence when it is required which should be most of the time. If you think about 14 years in the slammer for murder is the most punitive in the western world you are in ga ga land. Some Western countries use the death penalty which is slightly more severe than a decade and a half in jail. Well if you think the death penalty is a good thing you will end up with innocent people being executed. As I said in another thread, the number of cases being turned over by DNA testing just in Dallas County is remarkable, so I don't think countries like the USA can be used as a good example of a model Criminal Justice system. Using the maximum penalty most of the time is ridiculous also, you'll end up with a lot of people doing a lot of time for fairly minor offending, and the tax payer will spend a lot of money building prisons. And to solve what problem? I don't see that sentencing in New Zealand is light and in comparison with many European countries it is very punitive. I guess you have to ask what these long sentences actually achieve, they certainly don't act as a deterent otherwise the death penalty in the US would actually work, which if you compare murder rates with New Zealand it clearly doesn't. |

| 779514 | 2009-06-06 01:21:00 | Crooks in jail cant commit crime so there is an economic benefit to society keeping them in jail probably cheaper than their upkeep in jail. There is also the benefit of ecocomic activity infrastucture in building the jails. The best place for crooks is jail, radical thinking I know. I am not a death penalty supporter but if it must be carried out I like swift chinese method from court to court yard and a nice 9mm bullet to the back of the head. And you cant compare us to European countries because we have certain sector in NZ causing the crime, if you watch crimewatch you will see who is causing the problem. |

Judging by the comments on here, most people don't actually understand that the Judiciary don't actually make the laws in this country and have most likely never seen a Court in operation. Thats a load of twaddle!! The judiciary in NZ dont use the sentencing maximum as they should. They bail violent individuals onto the street, they allow drink drivers 4 - 6 - 8 - 12 chances to kill and maim, they sentence killers to 8 years for taking a life! We have far too many soft cock judges in NZ. NZers KNOW the judiciary dont make the laws. You only need to look at the likes of Millie Holmes to see how soft soft cock judges are. |
