| 780614 | 2009-06-08 14:00:00 | Why? The NZ Supreme Court hasn't done anything that makes it susceptible to be abolished and certainly not so soon after its inception. Add to the fact that its far cheaper to run trials that are held here than it is to fly everyone out to London and back, both in terms of cost and time. | beeswax34 (63) | ||

| 780621 | 2009-06-08 22:00:00 | The argument in favour of the Privy Council is that it gives us access to very clever legal minds. Its a bit like neuro-surgery. There are doctors in NZ who do it, but if you want the cleverest and most experienced, you'd go to New York. The argument against the Privy Council is many Kiwis can't see the relevance of judges 20,000k away. It's a fair point. Plus there is a high cost to access the Privy Council even if the British taxpayer bears most of it. Having a Supreme Court is seen as being independant and cutting colonial ties. What would improve it would be to merge with the Australian Court of Appeal - there was a proposal for a South Pacific Supreme Court. |

| 780622 | 2009-06-08 22:17:00 | Now there's an idea Winston! :thumbs: CER could become CJR (Closer Judicial Relations) Much more relevant to NZ and access to independent arbiters and a broader cross-section of legal opinion . . . Certainly I believe NZ is too small to be judicially independent, and with respect to our judges, it would be difficult to be entirely without bias . Many sporting codes have a system where if Country A and Country B are playing against each other they get a ref from Country C . Ramp that idea up a bit and you get the suggestion similar to that put forward by Winston . . . |
