798023 2009-08-04 12:38:00 Here is another one.

www.radionz.co.nz

In case the link goes I have a copy.

I would answer the usual way. I do not know as I was not there!

Helen Clarke had no idea that she was in a vehicle over the speed limit as she was doing some paper work at the time.

798024 2009-08-04 14:02:00 I can see that panning out well. Police say someone has knowledge of a crime which they don't and because they can't answer the question put by them they end up convicted. Whose the dickwit that decided to draft that law. mikebartnz (21)
798025 2009-08-04 14:24:00 With that many MP's voting for it, it must be stupidly wrong.
Which way would Taito have voted?

All I know at this stage is the bill has been passed by Parliament at this time. I was not there when the new law was drafted so I have no knowledge of this event. Possibly drafted by a civil servant at some time.

It still has to go before a select committee anyway.

Do not worry. As I have said before. You can simply answer, "I don't know." Or Yes or No for example.

This bill is possibly due to a whanau, in the past, not answering questions put to them by law enforcement agencies.

Whose the dickwit that decided to draft that law. They couldn't end up convicted unless the cops could prove beyond reasonable doubt that they had withheld information. Erayd (23)
798028 2009-08-04 20:46:00 Law seems a bit draconian, not incriminating yourself is a basic human right in Western European countries. prefect (6291)
798029 2009-08-05 01:15:00 Amazing! Simply parochial in concept and presupposes that one has knowledge of a crime - not a misdemeanor - and is therefor required to answer "Yea" if they have a hint of it happening .

Do they have to physically observe the crime or can they just hear about it in - oh, I dunnow - a BAR (NZ=pub)?

The police here in the US are not allowed to force a citizen to be so-conscripted by having them tell if they have seen any felonies or crimes being committed in their presence even! Never mind if it's just a rumor or third-party information! Citizens here have the 5th Amendment to protect them from self incrimination and that sort of police authority .

Take one giant step backwards NZ - it truly is Upsidedown Land if this passes! The Orwellian Mind Police are right behind this .

We don't go running to the Feds if we see a meth lab, f'rinstance .

We're not required to report it .

The Feds cannot even ask us if we have seen/saw/ a meth lab! Ever!

Well they are going to make it compulsory which sort of indicates that there will be some sort of punishment.

Yes - but only if they can prove you withheld information.

798032 2009-08-05 10:16:00 Not worth getting knickers in twist over this one. Law will get watered down.
And its all on the judges back, if you staunched it out and still didnt answer the polices question what are they going to do about it? You get 12 years prison here for first degree murder so the punishment for this might be a jolly good slapping with a soggy zig zag paper.
Once the first person staunches it out everyone will and the law will become an ass
Remember at school where the principal wants you to dob in your mates and you didnt same scenario.
