What is it with this Government?

Another bill being introduced without consultation with the people in general.

Not much different to the previous Government either for that matter.

We are in power so therefore will do what we like as we have a mandate.

For the record I did not vote Labour or National in the last general election.

I just sent my NO vote off for the latest referendum.

You all did vote did you not? I don't care which way you vote but you should vote.

Other guy had shoved him in a bath with water, with the intent on teaching him a lesson (or drowning him). Son smashed a bottle and struck back (more than once, I believe it was reportedly 5 times)

Son hates gangs, "victim" was Black Power prospect

Case where provocation could have been used?

Oh dear, that's awful for you and your family. The judge must have thought the situation was more balanced than your son believed.

Provocation is only a defence against murder. Not for other charges. And it isn't a defence exactly, what it does is reduce murder to manslaughter.

Instead of provocation, the usual argument is self-defence.

797680 2009-08-03 22:23:00 I believe that under some circumstances any person may kill another person or person in the heat of the moment.

Provocation is normally used to take out premeditation for example.

If you hire a detective to spy on your wife and he comes up with enough evidence to lead you to believe she is having a bit on the side and you then come home and kill the pair of them it would appear that you probably planned the killing anyway.

797681 2009-08-03 22:44:00 Did anyone see the programme "Sunday" on Sunday? A NZ businessman is in jail for murder in China after an unprovoked attack by several Chinese men in a restaurant. He claims self-defence and that the attacker died as a result of head injuries suffered during the fight.

If his version of the story is to be believed he is in one hell of a situation now with his entire family also paying the price.
