Sky prosecuted after installer falls off roof
NZPA Last updated 18:11 25/08/2009SharePrint Text Size Relevant offers
Sky Television is being prosecuted by the Department of Labour after an aerial installer fell from a roof, suffering serious head injuries.

Richard Twist was an accredited installer of Sky TV aerials working for Sky contractor City Aerials Limited.

He was hurt after falling from the roof of a house in Porirua, north of Wellington, in July last year.

Mr Twist was not wearing a safety harness at the time and Sky's safety instructions carry no reference to their use, Wellington District Court was told today.

City Aerials has already admitted it failed to take all practicable steps to ensure Mr Twist's safety and Judge John Walker today was asked to consider whether charges against Sky and Mr Twist's employer, Hugh Wilson, should be heard together.

Judge Walker decided to separate the cases with Wilson to appear on October 6 and Sky to follow four to six weeks later.

They will soon, thats what this case is all about.

In the legislation their is scope to ignore using fall protection systems on work that is less then 3m (though the obligations under the H&S act in regards to hazard control counter this) and morons have been getting killed left right and centre on falls of less then 3m on a pretty constant basis.

One bolt, One harness mount, 30 seconds.

Better then death or a lifetime of disability.

804192 2009-08-25 13:28:00 A week or two ago I watched a pair of clowns using a harness while one worked on a roof. The galah on the roof put on the harness with a great deal of cussing, then went up on the roof to do his water blasting. The ape threw the rope over the ridge of the roof and did his deed while the monkey on the ground held the other end. It was pretty noticeable that the roof ape weighed somewhere about 150 + Kg but the ground sloth was closer to 60 or 70 Kg. The ground ace was a bit bored so he knotted the rope around his waist and sat in the sun smoking. He shuffled away from the building PDQ when the upper idiot changed sides on the roof and much water and moss etc. came sluicing down. At this stage, the rope came off the elevated clown, over the spouting and led off at about 45 degrees to the low grade idiot now sitting under a tree smoking. It would have been interesting had he tried to push the rope to support his tumbling mate. Strangely he did not manage to pull the hoser off the roof, although that would be the only thing the rope was good for at that stage. I presume they were NCEA certified.
They worrying thing is that, had he fallen, he could have damaged a fair few plants (but I guess the blood and bone residues would have been beneficial to the surviving plants). No hard hat of course, but brain damage was pretty much out of the question.
Another notable technique was the idea of doing the path and decks first, then working up the walls, the roof, and to finish off by blasting the cap off the vent chimney.

804194 2009-08-25 13:34:00 Actually OSH will be prosecuted for failing to advise that a known hazard (Gravity) was running amok at the site and had been for some time. R2x1 (4628)
804195 2009-08-25 13:49:00 I hope umm Dicky Twist is ok ;) apsattv (7406)
804196 2009-08-25 21:22:00 Pity OSH and co weren't so vigorous in prosecuting Gov departments for deaths etc. You can die in a public hospital of neglect or wrong treatment and it's just a "Oh well, There was a system failure" but if it's private industry they're out there with their ticket books waving fast.. paulw (1826)
804197 2009-08-25 21:44:00 A word to the wise.

A few years ago there was a Life Insurance claim in Sydney. A guy painting his roof tied a rope to the tow bar of his car, threw the rope up and over the roof and began painting the side away from the car. You guessed it, wifey came out and hopped into the car and proceeded to drive away to shop. Poor chap was up and over the roof and onto the concrete below before he knew what had happened.
