| 814871 | 2009-09-29 00:30:00 | While researching my post above where more was tacked on I came across this. www.courtsofnz.govt.nz Makes interesting reading and I note that it comes from the Sentencing Act 2002. The case I was thinking of where more was tacked on is prior to that Act being passed so I guess no longer relevant today. Having said that I'm almost certain there was an appeal against sentence where the presiding Judge came to the conclusion that the original Judge was over lenient in the application of guidelines for one reason or another. There is no doubt in my mind that circumstances should be taken into account when a sentence is handed down and all sentences are made public. |

Let us have a system whereby all the facts of a case are published in this forum and also the Victim impact reports and Psychiatric reports and other reports and then have a poll to indicate the length of sentence that should be imposed. Or even the death penalty perhaps. Once upon a time ( this is not a fairy story ) or maybe it is. There was once a law against being Homosexual. Now there is a law saying that you can't discriminate as to sexual preferences. |

Personally I think people should be free to do what they want providing they don't hurt other people. Other people here believe you should be able to hurt other people, for good correction apparently. They then turn around and complain about the violent society, when in fact the majority of violent criminals were once on the receiving end of the same beatings they promote. So if beating people is so effective, why doesn't it work on those that have been beaten severely as young people? |
