| 815287 | 2009-09-29 21:19:00 | I am not a member of the get tough brigade - in most cases! This thread is not a "setup" I do have concerns at our justice system and how people use it . I have a small understanding as a result of nearly 10 years of CAB membership in the 90's . I do understand restorative justice and have been involved with this in a minor way . The problem is, how do you know when someone is truly remorseful, or just going along with the system to get a lesser sentence . I have had "clients" (to use the modern idiom) who have discussed with their support person about how they will lie to the police to get rid of an abusive partner . One case, they were prepared to "fabricate" that the partner was sexually abusing their children . This disgusted me and I walked out of the room and asked for our (woman) co-ordinator to take over . It was this the last straw for me and I resigned shortly afterwards . I think I just got sick of people constantly wanting advice on how to screw the system . People appear in court, dressed up nicely, hair cut, clean shaved and put on a great show for the court . I would be interested in statistics on re-offenders after restorative justice has been applied . As for the case in question, the offender dragged the old man out of the car and beat him to the extent that it ended his life . And then says "Sorreeeee" Ken People fabricating offences is one of the reasons why we have a Court system . Many on here would do away with with Courts and impose "Justice" themselves based on an allegation alone . The Sensible Sentencing Trust perpetuates this, they say criminals aren't entitled to legal aid . Well of course someone charged by the Police isn't a criminal, they're innocent until proven guilty . There are faults with any system and the likes of Peter Ellis could rightly ask why he did jail time for something that he clearly didn't do . Filling prisons will not stop crime, but it will most likely make it a whole lot worse . |

I am sure the guy had his reasons for hitting the old fella. Maybe we should understand other peoples culture more and just accept the sentence the judge hands down the judge knows the whole picture. The fact he was already a convicted criminal for assault has rightly not be taken into account the guy deserves more chances rehabilitate his himself. What right has the Sensible Sentencing Trust got to question a judges sentence. The fact there was no restorative justice because the Patel family don't want to talk to the offender is irrelevant the guy said he was sorry so everything is tickety boo. All round a great decision by a learned and well respected judge. |

| 815293 | 2009-09-29 23:10:00 | Our system is a joke. I read the story here: www.nzherald.co.nz and just cant believe how crap NZ is for sentencing, we may as well advertise for crims, let them know they can pretty much do anything here and punishment will be absolutely minimal. |

As the warder of Ch Ch prison,I am of the opinion we should keep them in here longer.If you saw how bad they are in here,you wouldn't want them out there!. As a hobby I do woodwork,in my spare time I am making a gallows,with the hope I get to use it. |
