If she was the reason for it ending, eg she cheated on you, I don't beleive she is entitled to as much, as if it was a mutural ending. Lawyers will win the most, if things get ugly, so I would try to keep it civil. Sometimes the woman can end up with over 60% and the house and car if their are children involved, so be careful. We did this before we got married, basically it means we both get to leave with what we brought into the marriage, wife asked for it to protect her assets for her son. Fine by me it stood for the first 5 years and has just run out this year, we wrote our own then just got the lawyer to write it up and make it legal, certainly cheaper. |

Not exactly and KiwiITT has already posted an explanation. But basically 3 years together means equal sharing of relationship property, never mind who paid for it. It is possible to contract out of this by a Section 21 Agreement. It needs to be clearly drafted and each party must be advised by separate lawyers. Do it yourself is a complete waste of time. |

Most over qualified truck driver in NZ with a MD!. Anyway I digress he is amazed here that a wife can root around on you leave you for another man and still get half your property. In Iraq he said you grab your trusty 47 track her down give her half a mag and the man the other half of the mag. And best of all you haven't even broken the the law. |

I settled for $80 000 less than half of the relationship property. Because although my lawyer was confident I'd win half of the family property, he said that several of the recent cases he helped win, it could take a year to get to Court, and each appealed which took up to a further 2 years. So we settled at a Court conference and I accepted, after much negotiation, just 53 Grand. |
