Selling Free software (that is, software under GPL or similar licenses approved by the FSF) is not only legal but strongly encouraged.

Having said that, selling Free software under false pretense such as pretending that it is commercially licensed or a 'retail version' is pretty dodgy. Trademe should not remove the sales as 'copyright infringing', because they (probably) aren't. But they'd be within their rights to remove the sales on the basis that the items are being misrepresented in a way that means buyers are being defrauded.

Anyone who parts with their hard-earned for a great free program like Audacity deserves to be fleeced. They should return their computer to the shop as they are too stupid to use one.

I remember buying a Ubuntu CD of Dick Smiths, for $5.00 maybe 5 years back. I couldn't be assed downloading it, burning it onto CD etc...

822976 2009-10-22 17:07:00 Not illegal at all. As it's licensed under the GPL, it's perfectly acceptable to sell it, as technically what you're selling is the CD / Media and your time invested in downloading it etc. and not the software itself.
Same goes for Linux Distro's - Nothing wrong with it.

Funnily enough my parents purchased a CD with Audacity, GIMP, and several other open-source applications for $40 a while back. Even once I told them it was all open-source and readily available to download their response was "Thats OK, I wouldn't have known where to go to get it all and download it. It's more convenient this way".
Dunno why they couldn't just give me the $40 and I'd have done it for them, I wouldn't have even charged for postage, but still ;)
