Eating, reading and smoking fall under that category if the officer feels it hampers your driving ability and attention . It is flat illegal to smoke in a vehicle with a child under 18 y/o in it though . There was a case where a newly-wed couple were having oral sex and they ran off the road and both died . Justice prevailed there . I once saw a woman make a complete clothing change in the car while she was driving . I had to close one eye to keep my depth perception to a minimum . Cellphones and texting are banned here too - but the fine is so small that people just wing it and play the odds . I say that they should get a heavy fine for using anything that causes them to look away from and not pay attention to their driving . |

Cant see how a fag in the gob is conducive to bad driving, can light it without taking eyes off the road. I had a mate who could roll a fag one handed whilst driving, most people could roll a fag with 2 hands through the steering wheel. |

| 826242 | 2009-11-01 21:49:00 | In the one sense yes it's just as dangerous due to the fact your attention isn't 100% on the road, but by the same token if you've got one already there, it's not difficult to pop it in your mouth and drive with one hand on the wheel when you need to take it out. I drive mostly one-handed anyways, but I'm not a smoker. That reminds me, I need to go to tv3's website and see if I can find that Campbell Live article about the new law and driver distractions .... |

C'mon guys . . . the law now says you can't use a phone while driving . Please accept the fact . I must say that the roads were better to drive on while doing my school run this morning now that the idiots are not phoning while driving . So far, so good! If you think smoking while driving is dangerous, submit it to your local Green Party representative for a bill to be put in the ballot box . Only problem . . . Greenies would want all ciggies banned except for hand rolled wacky baccy!! As Prefect said, I used to be able to roll a cigarette while driving a heavy truck . Steered with my knees . But that was in 1970, things are different now . Ken :) |

If you crash and you were smoking at the time, you will probably get charged with dangereous driving, because you were smoking. It should actually be illegal for smokes to be sold anyway. It was (and still is) termed driving without due care and attention which could include a multitude of perceived sins. Then an enforcement officer could issue an infringement notice and if you defend the said matter the prosecution has to prove it. When I last looked the sale of tobacco products is legal as of this morning as I bought a pack without any questions being asked. May I ask who are you to tell me and others how to conduct their life? |
