Although statistics consistently show that sober drivers have approximately twice as many accidents as drunk ones.

826033 2009-11-02 21:20:00 The law is quite peculiar about what constitutes driving; I have a friend who was convicted of drink-driving for being found asleep in the drivers' seat of his car with the keys in the ignition. He had no intention of driving, and the keys were in there because he'd had the heater on - police told him if he'd been in the back seat it would've been fine. :illogical

Many years ago I was witness in the UK to an even stranger case.
A somewhat happy chappy decided he should not drive - his car was on the hotel car park (private property) so he rang his wife to tell her to come and drive him home and fell asleep in the car - keys not in the ignition.
At this point I arrived with my friends to see the local cops had woken the chap up and wanted to arrest him for being drunk in charge of a car.
As he was on private property and had no intention of driving he resisted and the incident turned nasty.

On his court appearance the judge said he had looked into the matter and to HIS surprise discovered the way the law was written you could be miles away from home in a friends house, with your car locked up in its home garage and still be in charge of the vehicle and therefore the poor blighter was found guilty.

I believe the law was rewritten after that. To my knowledge (not large) this is probably the only case ever to have occurred in this manner.

Perhaps because there are a lot more sober drivers than drunk ones?

826036 2009-11-03 04:33:00 what is 'driving' actually? if i am stopped on the side of the road with my engine running and get my phone out of my glovebox to put in my pocket, is this legal? i thought the cops view 'driving' also as car stopped and engine running?

Pop back to youtube whilst driving and see what may happen.
