As some of you may remember, my son was locked up earlier this year. Prior to this he was living with his uncle in a renting situation.
When son came to court for his hearing, everyone expected he would be bailed. However the judge threw him inside while awaiting sentencing.

Ok, thats all good so far. Anyway, uncle is now looking for unpaid rent. As such he is holding sons gear until he has been paid (outstanding amount is $300+) at which time he will release it. Property has not much monetary value, but high sentiment value (son was given mink blanket from now dead aunty)

Is he able to do this? We don't think so and are not willing to pay. Hence I am seeking legal advice before attempting something like small claims or whatever avenue we decide to go down.

828219 2009-11-08 20:42:00 Rent is rent and it makes no difference that the landlord is his Uncle. The room wasn't available for another tenant so he owes the Uncle his normal rental, no argument, end of story.

I presume the Uncle is declaring the rental income on his tax returns?

828222 2009-11-08 20:58:00 First of all, sorry to hear of family problems, but you'll just have to suck it up and pay your son's rent. We all have to bail our kids out at times and it will save a lot of hassles in the future if he ever has to live with his uncle again.
