Happens pretty often, can't fire someone the worst that you can do against them is to refer them to someone else for rehabilitation. Using illegal drugs is illegal, end of story. What if this guy ended up killing someone because he couldn't concentrate properly? I bet they still couldn't fire him! Thank you political correctness, thank you very much. |

Going to work stoned and failing a drug test are two different things, THC stays in your system for up too 6 weeks. So saying the worker was under the influence of drugs during the accident would be very hard too prove. |

So blame the people who put the Employment Contract Act together. Personally I think the employer should be able to hire and fire who they like and when they like but that is not the issue here. |
