So saying the worker was under the influence of drugs during the accident would be very hard too prove. They can see if it was recent/heavy use due to the levels in the persons system. Only stoners think they aren't stoned after the initial buzz is worn off. |

He is the expert on Health and Safety I believe! Ken I have had issues with knobs smoking weed at work, Tried to fire them and ended up running into this offering treatment crap. Then lo and behold, one of my crew decided to spot some oil and then feel off a roof and ended up funked up and in Hospital.:( |

Most testing companies will return a "not negative" result if the drugs are in the system but in low quantities. (Ie smoked a day ago) If drugs are illegal, they should be treated as such. I say we test everyone on the benefit once a week, if they test positive, no payment for 13 weeks - just like when someone quits their job. If employees test positive, immediate termination. People chose to do something illegal, and they seem to think they are victims. They aren't. They should be punished. Same thing with drunk drives, if they crash and hurt themselves no ACC. That's the only way people will learn. If we have drug policies in this country, let's enforce them - Oh wait no, that'll infringe on their human rights... Boo... Hoo... |

And you will continue to think that until some ar@#hole of a boss fires your wife/mother/sister/son/daughter/brother, or, heaven forbid, you, for no good reason other than he's having a bad day and wants to kick somebody. THEN you'll change your mind and go baying for blood. Or perhaps an ambulance chaser who knows the rules and sees a dead-cert winner will talk big dollars and your eyes will light up. Get real; serfs and slavery went out years ago, and all employees are entitled to some basic rights. If an employer sets rules, he has to stick by them, even when it doesn't suit him, as this one just found out. Cheers Billy 8-{) |

The situation would be no different if the employee was drunk and chopping down a tree, or hadn't slept for 36 hours and was trying to drive a truck. |
