Using illegal drugs is illegal, end of story.
What if this guy ended up killing someone because he couldn't concentrate properly?

Going to work stoned and failing a drug test are two different things, THC stays in your system for up too 6 weeks. So saying the worker was under the influence of drugs during the accident would be very hard too prove.

Pity there is not a test for stupidity - which would be able to be used as a reason for his dismissal.

Where is Metla on this??? He is the expert on Health and Safety I believe!

If the Company did not follow the rules then the ERA really have no option but to uphold the claim.

So blame the people who put the Employment Contract Act together.

Personally I think the employer should be able to hire and fire who they like and when they like but that is not the issue here.
