If there is no living family who still live in NZ (none that I actually know in person, in any case), what would happen? Lots of people would cry. Seriously? Go make a will. The Public Trust do a really good one, costs nothing and you know your stuff will be distributed according to your wishes. LL |

| 833225 | 2009-11-26 00:41:00 | If you die intestate (no will) and you have no heirs as defined by the Administration Act 1969, then your estate will be held by the government in the consolidated fund. There used to be lists of such estates in the back of Truth inviting claimants to come forward. I do recall dealing with an estate once from 1948 which owned valuable shares in an English company and a claim turned up in the 1980s. None of this prevents your ex claiming or indeed any other person but they have to prove the claim in the High Court. If you owed a significant debt, your creditor can apply to administer the estate and be paid. |
