If you have the legall right of way, and you take it, when it was/is unsafe to do so, and an avoidable collision occours, you are no longer in the right, because you failed to exersise "due care".

Thats the way it is, which in due course you will learn.

Was caught for dangerous driving in October, got a phone call a week later, they said "just be more careful next time" and that was the last I ever heard of that.

Brother was done for dangerous driving a while back, just a fine (and possibly demerits), no lose of license.

And I'm not even going to start on your "you're in the wrong if you do something right" bs.

You're not only arguing with me, but if you take a look, every other sane person in this thread can see how thick you are.

WHAT JUDGE WAS THIS, IN WHAT COURT, ON WHAT DOCKET NUMBER.

The sentencing directions contain the word SHALL.

In legall terms that means the judge has no choice, as in: found guilty of murder SHALL be sentenced to life inprisonment.

What then is "Careless" in regard to "Careless use of a motor vehicle" (Did use a === Motor Vehicle, Registration Number ====, in a Careless Manner on === at ===)??

The written terminology in the charge,

If the Act and its related Laws are written with this sort of basic misspelling of words, then they will struggle to hold up in a court.

847050 2010-01-11 02:48:00 Its been mispelled because these offences against the act have been fabricated by angry on his 101 keyboard and not copied from a gazetted law.
I had a mate who when his car got scratched or dented he would drive it to someone not giving way on a roundabout (he used same roundabout Swanson Dons Buck Universal about 4 times).
Only into a flash new car and get his car fixed for free.

847052 2010-01-11 03:54:00 I was exercising due care while driving dangerously, maybe that's why I got a phone call a week later with the cop telling me to be more careful next time, and he even had a bit of a laugh about it.

And don't accuse me of lying. All you've done is post bs from your ass as well as searching some keywords to a site that isn't even official NZ Transport.

I've told you two personal experiences. Nothing beats that. Bet you don't know a single person who has been caught driving dangerously. Just because the law says so, doesn't mean it has to be that way.

The law says I can't speed. If I tell you I sped on the way home, and didn't get a fine (even though your site says I HAVE to get a fine) would you call me a liar?
