847035 2010-01-09 07:17:00 According to angrys logic, every time we go through a green light or anywhere we have the right of way, or pretty much do anything legal, we can still be done for dangerous/careless driving. So EVERYONE in a crash is at fault because they didn't avoid it?

And you do not lose your license for driving through a red light, and it's still seldom to lose it for dangerous driving.

is one of the phraseologys in: inconsiderate/careless/ dangerous, use of a motor vehicle.

IE the use of the vehicle was careless in that the operator did not try to avoid a collision because he had legall right of way.

common at red light running, 2 people see red light runner and stop.

no 3 dosent stop, and screams I HAD RIGHT OF WAY, after he collides with red light runner, he could clearly see, and should have avoided.

1 get written up for running red light, damgerous driving, other for, carless use "failure to avoid".

both will lose licences.

we will start with you, because you are the easiest.

Dangerous driving carries a MANDATORY 6 MONTH DISQUALIFICATION.

LEARN YOUR ROAD LAW.

If you have the legall right of way, and you take it, when it was/is unsafe to do so, and an avoidable collision occours, you are no longer in the right, because you failed to exersise "due care".

Thats the way it is, which in due course you will learn.

Let's say I see a vehicle coming though the red light and stop in a hurry.
The following vehicle collides with the rear of my car.

NO, the Vehicle behind you was following to close, which is why it hit you (or the driver wasnt paying attention) and the driver is guilty of, careless use.

did you read my post as the driver of car 3 hitting one of the two stopped cars, or the red light runner ??

I meant it as car 3, striking red light runner.

About 20 miles per hour he was doing but that was on the footpath and pedestrians were moving on to the road.

none.

car 3 did not exersise due care, an so struck red light runner, both are wrong.

car 3 was not paying attention to what was happening around him/her, should have seen others stopping odly and exersised caution (slowed down, looked more carefully prepared to avoid (:)all things that MUST be done at every intersection)), thus avoiding collision.
