The towies rang us. We said we don't want the car.
They said it is under our name.

We also spoke to the police that we don't want the car if it is recovered, this was 2yrs ago, it was found a few months ago.

If it has been recovered since then I would say it is the insurance company's problem.

No. The car has been unused parked on private property.

2yrs ago. First time recovery we paid the towie to get it back but 48hr it was stolen again. Recovered a few months ago.

I don't believe you have to pay the towies, because the 'loss' the towies have experienced, was directly related to a 'crime' . Infact I believe you should ask the towie to contact the police, who will confirm to them that the car was stolen, and the police should then contact you to tell you that they have found the car . It would be the person who stole the car, that should be liable for the towies bill . I mean how do you know it wasn't someone working at the towies, that stole it, and they are now exhorting money from you . Sounds dodgy .
But then again on paper you do 'own' the car . . . maybe you should contact your CAB, for the exact law on this .

So the towies know it was stolen .

WHat documentation do you have that show that you 'own' the car. How do you 'cease' owning it. I would get advice from the CAB on this as it maybe a cost you have to pay. Normally it would be covered by insurance anyway.

I have no evidence that shows that we own the car .
The towies say it is under our name .

We have 2 forms from the police after we filed a stolen car . It was stolen on 2 separate occasions .

You are probably listed as the owner on this website . ppsr . govt . nz/cms" target="_blank">www . ppsr . govt . nz
You may need to ask them what proof they have that you are the owner . They may just have you down as the 'previous owner', so legally they may not be able to do anything . However if you reported it as stolen to the police, then you are essentially saying that you own it, and it has been stolen from you, hence you own it . They therefore maybe using the police report as proof that it is yours .

Exactly, he is victim of the crime, and the victim shouldn't have to be out of pocket, the company should be pursuing the thief.
I once had my wallet stolen, and the thieves used my library card just 1 hour after stealing it, to then take out a whole lot of CDs from the library which they never returned. I ended up being sent an overdue notice. I reported the theft to the police, but forgot that I even had a library card in my wallet, so didn't report it stolen to them. I told the library all this, and never had any reply.The library ended up putting the debt into baycorps hands, even though they never told me they were taking this step. After much effort the library dropped it's claim. They have absolutely no security.
