| 855302 | 2010-02-04 07:56:00 | When I bought a TomTom Vehicle GPS in early November last year it's documentation came with a "Latest Map Guarantee". This stated:- If a more recent map has been released within 30 days of using your device for the first time, you can download that map, free, at TomTom HOME When I first connected my device to the Internet it immediately offered me a newer map than was on my unit. This map was released back in September, but because the device came out of the factory prior to this time, the September map was more recent than that on my unit. I downloaded the map and all was well.... In late November TomTom released a new map. As it was released within 30 days of first connecting the device, I though I should be able to download it for free. I found however that I was unable to. I contacted TomTom Help Support and was told Sorry, you are only entitled to one free map download, you have done that when you downloaded the September map. My first question to them was Where does it say in the Guarantee that I can only have ONE download? They referred me to a web page which wording was considerably longer and does say buried within the wording only one download allowed. I do not know where the law stands on this, but to say one thing in the enclosed documentation, but then another on a web page (which can be changed at a whim), which legally should they have to stand behind? Also the September map was NOT "released within 30 days of using your device for the first time" and therefore not covered in the Guarantee. What also annoyed me is that that currently on the TomTom web site they are advertising new units with the following statement:- Your device houses our best maps and our latest map guarantee makes you right up to date. If we release a new version of your device's map within 30 days of your purchase, you can download that map for free via TomTom HOME desktop software. Again they do NOT mention the ONE download only. TomTom release a new map around every 3 months, so may release one soon. If you purchase a new TomTom, and offered a new map on first connecting to the Internet via their TomTom HOME software, the unit does not have the November map release. I wouldn't accept it immediately. I would wait until up to 30 days so that if a newer map comes out I could download that. Don't forget to though, it you go past the 30 days, you're out of luck :( |

I did not read it closely enough and thought flashman had a point to argue until I noticed your text in bold. This bit: If we release a new version of your device's map... refers to the map in the unit flashman bought, meaning that the map he downloaded was in fact a newer version. So I guess what this means is to wait as long as possible to find an updated map - but I wonder if this has to be 30 days after purchase or 30 days after registering online? |

Flashman is right, in that it is not clear on the package that you can only have a single download, as such restrictions must be clearly advertised . You shouldn't need to go onto the website, and then read the fine print to find what is a major restriction . However to argue about it is probably a waste of time, and the difference in the maps would be nominal . The 30 day map guarantee and terms were all written overseas, so they possibly don't meet NZ consumer laws . You could complain to the commerce commission that their advertising isn't clear, but it is probably isn't worth your time, and then they probably don't have the resources to follow it through as it is pretty minor . I've made a compliant to the cc before, and never had any reply or heard anything back . |

It wouldn't cost them anything to provide you with the all the latest maps within 30 days, and it would keep the customer happy. |

I watched the video and it gave an example of a road block so it is not certain if new roads / routes can be shared . flashman, I suggest you send Tom Tom Australia an email giving the URL for this thread . Send a copy to the main headquarters (USA, UK?) and any other Tom Tom offices . I agree with a previous post regarding the NZ Commerce Commission; imo it would be better to let Tom Tom executives know that the "Latest Map Guarantee" is being exposed on a site that gets world wide attention . |

| 855311 | 2010-02-04 19:38:00 | I had the same issue with Garmin..maps with the device were out of date (for a new piece of roading in Lower Hutt), entitled to one upgrade that you had to take within 30 days. Downloaded the update and this also did not include the new road. Had a whine at Garmin who shrugged and said "only one update allowed". Bring on Google maps (which is up to date BTW) and free navigation on Nokia phones. These GPS companies need to wake up, continuing this policy when there are now, free alternatives is just going to drive down their value. Also because of Google, I've heard that Tom Tom are doing free map upgrades on selected models in selected locations - investors.tomtom.com So there may be hope for us. |
