861156 2010-02-24 02:41:00 Ol' Tiny Blue Eye now strikes fear into students hearts, not to mention the FBI .

The school spycam scandal in Pennsylvania (see "School denies remotely eyeing pupils ( . newsletters . siliconvalley . com/ygsmqkvzbbmngtlcnfrglnpzypnmwrygwfkrtwkcmbkkkv_krl" target="_blank">click1 . newsletters . siliconvalley . com rpmvrhshs . html)") is branching out in several interesting directions, now including a federal investigation ( . newsletters . siliconvalley . com/skljvmpdssjtkhrltcfkrtzdwztjgfwkgcmfhgmljsmmlp_krl" target="_blank">click1 . newsletters . siliconvalley . com rpmvrhshs . html) of the possible monitoring of students through their computer webcams .

There is, of course, the "could this happen to me?" angle (Larry Magid on Cnet . com says yes indeed ( . newsletters . siliconvalley . com/zbszpsftwwzklqmdkbjlmkgtvgkzcjvlcbsjqcsdzwssfr_krl" target="_blank">click1 . newsletters . siliconvalley . com rpmvrhshs . html)) .

Then there's an element of "what is the world coming to?"- a jaw-dropping look at the surveillance setup at Lower Merion School District — "a massive, highly effective digital panopticon" — is provided by blogger Stryde Hax of the security group Intrepidus . ( . newsletters . siliconvalley . com/bjldfgztccdyqmlbyjkqlystvsydnkvqnjgkmngbdcggzj_krl" target="_blank">click1 . newsletters . siliconvalley . com rpmvrhshs . html)

The blog post also points readers to comments by past students on the tight monitoring of their computers ( . newsletters . siliconvalley . com/mtwwynpkbbwldvqsltgdqlzkmzlwjgmdjtngvjnswbnnpd_krl" target="_blank">click1 . newsletters . siliconvalley . com rpmvrhshs . html): Students were required to use the monitored Macbook; any unmonitored personal computer would be confiscated; and jailbreaking a school laptop to secure it or monitor it against intrusion was punishable by expulsion .

"The light next to the webcam would randomly come on," one student said . " . . . We reported it multiple times, each time getting the response: 'It's only a malfunction . If you'd like we'll look into it . ' "

Stryde Hax refers to such requirements as "compulsory transparency" and adds, "I never thought I would be using the phrase to describe America, especially so soon in the first years of the Obama Administration . "

And, finally, there are the just plain silly aspects of the case, including the revelation of how Blake Robbins, the student who has sued the school district, first found out he was being monitored: Blake reportedly was told by the assistant principal that the school had pictures of him with illicit drugs in his home .

Those "drugs," says the teen's lawyer ( . newsletters . siliconvalley . com/fnsqhjyfggqwnlsrwbznswcftcwqpztnpbjzlpjrqgjnqs_krl" target="_blank">click1 . newsletters . siliconvalley . com rpmvrhshs . html), were actually the fruity candy Mike and Ike . ( . justborn . com/mike-and-ike" target="_blank">www . justborn . com)

I late news of the situation, the school attorneys stated that the school had "no evil intention" to which the syndicated On-Air personality, Bill Handel (Handel-On-The-Law - KFI 640/AM (javascript:play(32618,0,0,0);) radio) stated: "If you rob a bank and 'intend' to give the money to a church, your INTENTIONS may have been good but you still broke the law in the prima-facia robbery" . Uh huh .

Looks like the school is hung out on this one as it is a total and non-defensible violation of Federal Law against illegal wire-tapping - make that MULTIPLY punishable, as some ex-students who were arrested by evidence seen on the school's system and the students had rolled-over and just took the non-judicial punishment as legal, have now decided to file a class action suit against that same school and the superintendent of Education of the State of Pennsylvania .

The big stink has hit the fan blades .
