875059 2010-04-12 06:48:00 Parole is or at least should be a matter of risk management. The primary factor in assessing the risk of reoffending is previous track record. Other factors in order of importance include his behaviour while in prison (again, to best of my knowledge this has been exemplary), any evidence of drug use (none) and whether he has expressed threats to anyone (none) or remorse (yes if I recall correctly)

Given that to the best of my knowledge Bruce Emery has no prior criminal record, and there are no other factors that offset this then it would appear that he is a low to very low risk to the community. On that basis he should therefore be paroled, in order to save further expense and to free up the prison resource for another offender that does pose an ongoing threat (and there are lots and lots and lots of those)

However I would not go so far as to say he should be getting medals, compensation or any other indications of public approval. He made an understandable misjudgement that night with terrible consequences that he and his family will have to live with the rest of his life. The behaviour of the victim undeniably amounted to provocation, making this a quite unusual case, with the usual clearcut boundarys being blurred. This is the point that Tweak touched on quite correctly

If the teenager hadn't been tagging, he would still be alive and no one would have been in jail.

Its not as if he killed someone while robbing a bank at gunpoint.

Of course the *victims* family will want him to rot in jail for as long as possible but in this instance, the home owner whose property was being tagged is just as much a victim.

Ideally he shouldn't have gone after the teen with a knife in his hand but that is in the past now. Nothing is going to be gained in keeping him locked up any longer. And the chances of him killing someone else is probably fairly low when compared to some other release cases there has been in the last couple of years.

The fact that he reacted so voilently to petty crime indicates that he musnt be quite right in the head. How many of you here would stab someone to death if you caught them tagging?

Nope, water bombing has been my most rebellious effort. If someone chased me and stabbed me to death, would you think they have something wrong with them mentally or be happy for them to be out on the streets again after only a year???
