Remembering of course that this is a fines only offence carrying a maximuim penalty of $2000 and therefore he cannot be sentenced to imprisonment. Can't sentence more than the law prescribed maximum. Add to that the fact his photo (and video), name and circumstances have been plastered all over the news for a week or so. That is a penalty in itself and would have been taken into consideration. I wonder if it would have gathered the same amount of attention if he had pulled up outside his dear old Grandmas house and was delayed helping her into her wheelchair and getting her things together before he took her out to do her grocery shopping. |
