1152528 2010-11-14 12:38:00 The company who released the lp are long out of buissness.

Also, the musicians on the recording were given a 1 off payment for it.

I'm on a Music forum that has people on there who release CD's for EMI etc.. and know all about this stuff. I checked there first.

Those pictures are just from google search. I used them so i could have a background.

If any of the picture owners have objections, i will take the pictures down.

Do you still go to school? If so are you taught ethics, moral values and the like?

1152529 2010-11-14 15:13:00 It's also worth pointing out that unlike the USA, we don't have fair use provisions in our copyright laws here. Unless you know exactly where those recordings came from, *and* they are licenced for use on your website (either directly, or via a licence such as Creative Commons, public domain release etc), then using them is illegal.

It looks like the NZ copyright act has changed.

New section 81A inserted

The following section is inserted after section 81 (www.legislation.govt.nz):

“81A Copying sound recording for personal use

“(1) Copyright in a sound recording and in a literary or musical work contained in it is not infringed by copying the sound recording, if the following conditions are met:

“(a) the sound recording is not a communication work or part of a communication work; and

“(b) the copy is made from a sound recording that is not an infringing copy; and

“(c) the sound recording is not borrowed or hired; and

“(d) the copy is made by the owner of the sound recording; and

“(e) that owner acquired the sound recording legitimately; and

“(f) the copy is used only for that owner’s personal use or the personal use of a member of the household in which the owner lives or both; and

“(g) no more than 1 copy is made for each device for playing sound recordings that is owned by the owner of the sound recording; and

“(h) the owner of the sound recording retains the ownership of both the sound recording and of any copy that is made under this section.

“(2) For the avoidance of doubt, subsection (1) does not apply if the owner of the sound recording is bound by a contract that specifies the circumstances in which the sound recording may be copied.”

So as long as those conditions are being met.

1152530 2010-11-14 16:49:00 Will he go to jail now; repeat offender and all that?

Just to be safe I ran CCleaner to take all searches off my system in case they ask me if I know him.

I don't.

This looks bad though, even in the US with our laws.

We can't even have a portable radio playing in a workspace that a paying customer might accidentally hear as that is an infringement too.

The music cops here are pretty tough.

Are you saying that the NZ laws have opened up or become more Huxley-like?

1152531 2010-11-14 18:47:00 I think NZ laws have just confused everybody more so than they were already :p SoniKalien (792)
1152532 2010-11-15 05:04:00 It looks like the NZ copyright act has changed.Yep - that went through a while back to allow the use of MP3 players and the like. It's still not a proper fair use provision though, and it still doesn't allow what Goodiesguy is doing. Erayd (23)
