The technicality is the council she used to work for no longer exists therfore not being rehired to the same job with same employer. Happend to me twice before first time where I was working was taken over by another company and we were all made redundant, new company took over an rehired all the old staff we kept our redundancy but started from day 1 on a new contract. No differance really! One exploit I fell victim to of this contractural BS was an employer I worked for couldnt get rid of us so he dissolved the company and made some BS papertrail sale of the business to his sister. Guess what we became redundant!!! Given chance to reappply for our jobs and never remployed! Needless to say it did backfire on him on a technicality he missed. Happens all the time you just had the media hounds jump on this which they would not have done if it was you or me. |

Seems to me your confusing the ratepayer with a legal right under the employment act that anyone employed is entitled to. I doubt there was anything in her contract that said she must give back any redundancy money if appointed by another council? Which is what the Auckland Council is now and whats happened. As a ratepayer you should now get onto your elected council official and pursue this point be raised in any contracts however it will not happen because it would affect any employees right across the country. Lets put it this way as a Ratepayer in another council I might add, I think it sucks but thats a legal loophole. I got a fight going with my local council over an issue or two and I did throw my toys out the cot in regards an involvement I had with the council, that has now created another problem and hey the council owes me money. Yet they are able to get away with some crap because it is legal for them to do so. Oh and I still got to pay there rates bill even though they owe me money. |
