Yep - you don't need to be driving to be "in control" of a motor vehicle. Passengers can be charged with careless use of a motor vehicle if their actions have caused some incident. In saying that there is an infringement notice for "carelessly opens door" which would be issued as an immediate fine in less serious cases. |
