1186808 2011-03-16 22:41:00 I think there is fault with 3 parties here, the door-opener, the cyclist, and the truck driver. Clearly none was fully aware of the environment and their surroundings. The door-opener should have checked more closely, but depending which part of Tamaki Drive, there are some parts there where the road curvature means you would literally wait forever due to short visible distances. The cyclist, in my view, should know the be cautious of opening doors when passing parked vehicles - and perhaps slow a bit so you can stop if needs be, especially if you have a FREAKEN TRUCK RIGHT BEHIND YOU. And the poor trucky, perhaps it was bad timing, but clearly also didn't expect the cyclist to swerve in front of him. Was that just bad luck, or was he travelling faster than conditions (including vehicle volume and potential hazardous objects) suggested?

Ultimately, I don't believe the driver should be punished severely - let's face it, the drunkard who drove into a cyclist and killed them only got 10-months suspended licence and some community service - but it should be a reminder to drivers AND cyclists about visibility and opening doors. Personally, I think if cyclists want to ride on the road, it should be under the same rules & conditions as a moped.

So from the sounds of the article the driver did not open the door and hit the cyclist. As far as I know there is no 'give way' rule when it comes to opening a car door.

I wonder if the charge will stick in court. What do you think?

IMO, and I dont have all the facts, ie: door opened & cyclist rides into door, or whatever, however, I would say the cyclist should have been on the damn cycle path, thats what its there for!, 2nd, did the cyclists NOT expect the door to open?, what was she watching?, 3rd, I dont think there is a law about opening the door.

Just more PC nonsense if you ask me!

I can't see anywhere that Agent seemed to think the circumstances were clear...he is just quoting from the road code...........that is how wars are started :lol:

It is. The AK CC for one of their obscure reasons put a tank trap in the middle of the road to make it real narrow. I think that they do that to keep their engineers and contractors in work or that's they way it seems to me in Auckland...

The road code is written and based on Legislation but it's not the actual legislation as passed by Parliament.
