| 1186798 | 2011-03-16 08:22:00 | So the police have charged a driver because the CYCLISTS dodged a car door: www.nzherald.co.nz So from the sounds of the article the driver did not open the door and hit the cyclist. As far as I know there is no 'give way' rule when it comes to opening a car door. I wonder if the charge will stick in court. What do you think? |

| 1186799 | 2011-03-16 08:35:00 | The car door didn't hit the cyclist, have to prove therefore that the driver caused a fatality. I'd get a good defence lawyer and at least make them prove the case. If I was the Judge, I'd send the City Council to Home Detention for six months for allowing a crazy road configuration. |

| 1186800 | 2011-03-16 12:03:00 | Is that the road that is real narrow? I remember seing something on the news or similar programme saying it was bad for cyclist there. I don't think the blame should be fully with the driver, I check mirrors etc when hoping out of my car when parked on the side street, but also the cyclist herself should be aware that you should allow room for a door to be open as cyclist arent always easy to see. Also Im pretty sure Id perfer to cycle into a car door than a truck, it must have just been one of those things. Tragic for both the cyclists family and the driver for sure. |

I used to ride a bike for many years and had a few close shaves at least half of which were caused by me. If the vehicle driver had not been alert there is a fair chance I would have been toast on more than one occasion. | CliveM (6007) | ||

| 1186804 | 2011-03-16 20:31:00 | What is the difference between opening your car door into the path of a cyclist, and pulling out into the same place without looking or signalling? Personally, I don't see the difference - in either case you are negligently or carelessly creating a potentially dangerous obstruction to the traffic flow. Recently we had a thread about a driver pulling a u-turn into the face of oncoming traffic (was it pctek's thread?). There was general outrage about that behaviour - why is it different now? My guess is that in the u-turn thread, the outraged were car drivers, and in this case it seems to be less of a crime because the victim (who was killed by the way, not merely frightened) was a cyclist. Personally, when I am cycling (and when I was motorcycling), I keep an eye on parked cars because of the danger of door opening and unsignalled pulling out - if I notice there is a person in the driver's seat, I give them a wide berth because all car drivers are stupid at some stage of their lives. However, it is still the driver's responsibility to check for all road users before doing something that compromises the flow of traffic and could be a danger. |

| 1186806 | 2011-03-16 21:06:00 | Pretty straight forward, the person who opens the door into a cyclist has committed a crime in my eyes. To plead not guilty the person must be scum. He gave the chick cyclist a choice: Choice 1 smash into my door Choice 2 avoid the door by going around it. Deserves a lengthy period in jail for not manning up. |
