| 1244237 | 2011-11-18 05:52:00 | So September last year (2010) was when I purchased my graphic card (Gigabyte GTX 460 1GB OC version) from PB Technologies in Penrose. The card has been recently playing up and I get the display driver crashing sometimes. The screen also turns all different colours occasionally when i'm playing games and I have to turn off the pc from the wall and restart to get rid of it. I contacted PB today and they said would replace it with the EVGA GTX 560 (NON TI VERSION). I payed $390 for my GTX 460 and I do not expect it to start crapping out this quickly. The link to the replacement: pbtech.co.nz I asked if I could pay another $20 and get the 560Ti, link: pbtech.co.nz They said they couldn't do this due to "Depreciation and a 20% restocking fee" I told them that under the Consumer Guarantees Act there was nothing relating to depreciation and a restocking fee as I am NOT selling the card, I'm just making a warranty claim. Their answer to this was to repair it and that they would have the card sent to GIGABYTE to get replaced which would take 3-4 weeks. My current system is a sandy-bridge and without a GPU I cannot use my PC. So getting them to send it back is out of the question as I also do not trust PB, I have read more stories about them and It is not likely i will get a replacement card from GIGABYTE within 3-4 weeks. more like 3 months. So I paid $390 for the card. Am i entitled to say to them that you have to replace the card with another card that is currently worth the amount I paid originally ($390) or can I get a full refund? I am prepared to take them to disputes tribunal if I have to as on the phone they didn't seem like they wanted to go with any other remedy. I am also happy if they can settle this with me by giving $340 refund which is reasonable. Thanks for help in advance. |

Sorry dude, it didn't crap out in one week, it crapped out after year. Either take the 560 (you should!), which is a better and newer card, or wait for 3-4 weeks and see what happens. PB Tech is absolutely right, IMO. They seem to be meeting CGA requirements. Take their deal. |

They are allowed to choose the replacement (that's the way the act works, usually they give you multiple options). Funny, my gigabyte card behaves exactly the same, I am considering sending it back now. But the re-stocking thing is that they cannot restock or charge you for an item that is faulty. I would call it replacing it with something of equal performance. |

CGA does not offer you a right to a refund. You have the right, if they can't fix the issue in a reasonable time (3-4 weeks would be deemed reasonable), for an item of similar-type - which they are offering you. This is at their discretion, you can't force them to give you a refund if you don't want to (and can repair it). You can get a refund only if they can't fix it or offer a decent replacement. The 560 is the successor to the 460 - so you are getting a newer product. Prices drop all the time, that doesn't mean you can abuse the CGA to profit from this by getting a refund for last year's prices today and somehow benefit by it, which you seem to be doing, rather than having your problem fixed. |
